In Mass. law, states get a health overhaul model

BOSTON (AP) ? When Massachusetts adopted its landmark health care law in 2006, the goals were ambitious and the potential solutions complex.

More than 90 percent of its residents already had health insurance, but the state hoped to cover nearly everyone by plugging as many holes as possible in its system, short of a so-called single payer option.

What resulted was a state law that became the blueprint for the 2010 federal Affordable Care Act signed by President Barack Obama.

Now, as other states begin grappling with the intricacies of the federal health care overhaul, many are looking for lessons from the largely successful Massachusetts model as well as from its limitations and remaining challenges.

Officials from Wisconsin, Minnesota, Colorado, West Virginia and Rhode Island have worked with Jonathan Gruber, an MIT economics professor who helped craft both the state and federal laws, to set up their exchanges.

What are they getting in return? A guide to a law that has resulted in more people visiting doctors, more employees getting coverage through their jobs and an increase of insured residents to 98 percent, far above the national average, including virtually all children and senior citizens. That's an additional 400,000 people with insurance since the law took effect.

Other states would also do well to note the difficulties resulting from the law: a shortage of primary care doctors, which is expected to be an unintended consequence of the federal law, and an increase in the number of procedures that insurers were required to pay for, which raised costs.

Massachusetts' law, written for a state that is relatively richer and more highly educated than others, won't be a perfect fit for any other state, of course. But the experiences resulting from the law have played out on personal levels universal to all 50 states ? in doctor's offices, at kitchen tables and in human resource departments.

Among those most directly affected were the uninsured who had relied on care from emergency rooms, the cost of which was borne by hospitals and taxpayers. The law's top objective was to get those people into health plans. A system was created to subsidize care for people earning less than three times the poverty level and design lower-cost private plans for those earning more.

For Valerie Spain, the overhaul proved to be a lifesaver. She was underemployed in 2011 and no longer able to extend her insurance coverage from her previous job, an option that had been costing her $550 a month.

The 57-year-old former operations manager found insurance through the new subsidized program. She pays a $20 co-pay for visits to her doctor's office but no premiums.

Without the insurance, Spain said she doesn't know how she would keep her diabetes under control.

"I'm sure I would have had to be rationing my medication," she said.

The influx of such new patients is good for those who finally have insurance, but it's been tough on doctors, said Richard Dupee, a 67-year-old primary care doctor and chief of geriatrics service at Tufts Medical Center. He said many have declined to accept patients on the subsidized plans because the reimbursement rates are not as good as private plans.

"If you nickel and dime the doctors, they are not going to take the insurance," said Dupee, who has been in practice for more than 30 years and teaches at Tufts University School of Medicine.

The state also faces a shortage of primary care doctors, Dupee said, making it harder for the newly insured to get an appointment. He said the bulk of his students are heading into subspecialties, with few choosing primary care.

Just half of primary care doctors were taking new patients last year, and average times for new patients seeking appointments with the doctors remained long ? 45 days, up from 36 days the year before, a Massachusetts Medical Society survey found.

"If you are going to insure everyone, you have to make sure that you have doctors to care for those people," Dupee added.

Another struggle for Massachusetts has been its attempts to curb the costs of the law, said Lora Pellegrini, president of the Massachusetts Association of Health Plans. She faulted lawmakers for mandating that insurers cover more procedures and medicine, including hearing aids, oral cancer drugs and an assessment to help pay for the state's childhood vaccine program.

"To ultimately be sustainable, we have to address the costs," she said.

The state has worked to do so. In August, Gov. Deval Patrick signed a bill intended to save Massachusetts up to $200 billion over 15 years by encouraging a system that rewards doctors and hospitals for keeping patients healthy rather than paying piecemeal for every operation or treatment.

Employers must also brace for changes. In Massachusetts, businesses with 11 or more full-time workers were required make a "fair and reasonable" contribution to their workers' health insurance or pay a fee.

At family-owned Needham Electric Supply, five more employees began getting insurance when the law passed, said Vicki Maderia, director of human resources.

The company had considered the workers part-time, but they were deemed full-time under the law. Maderia said the cost was minimal.

"It helped us be a little more marketable because of a lot of the part-time workers were looking for benefits, so it did help us on the recruiting side," she said.

One key to the success of any health care law is to connect with people in their neighborhoods or at home to explain the law and get them enrolled, said Brian Rosman, research director for the advocacy group Health Care for All.

For example, residents need to be made aware of the individual mandate, which requires virtually everyone be insured or pay a tax penalty. Massachusetts was the first state to impose the mandate, and the federal law also includes one.

About 170,000 people in the state said they were uninsured in 2010, but about two-thirds did not report enough in income and were exempt from the tax penalty.

Of the rest, there are plenty of reasons why someone might be penalized rather than have insurance, said Rosman.

Sometimes it might be due to the difficulty of reaching out to Spanish- and Portuguese-speaking populations. In other cases, he said, some people are simply philosophically opposed to being told by the government to get insurance.

The number of people assessed the penalty has fallen steadily since the law was passed, from 67,000 in 2007, the first year the mandate took effect, to 44,000 in 2010.

Gruber said the most challenging part of establishing Massachusetts' exchange was that the state was essentially starting from scratch. There was new software to be developed and critical decisions to make.

"We really were experimenting," he said. "Other states will have, in many ways, an easier time than we did."

Women in combat: Will they have to register for the draft?

That may be a difficult question from a societal standpoint, but the answer is straightforward, according to a legal analysis. On Thursday, the Pentagon will lift its ban on women in combat.

And as a practical matter: When women turn 18, will they now need to register, as men do, so that they can be conscripted in the event of a World War III, or any military emergency where the US government decides it needs troops quickly?

It?s a thorny question, raising what may be a difficult prospect societally. But the legal implications are obvious, analysts argue.

?The answer to that question is clearly yes,? says Anne Coughlin, a law professor at the University of Virginia School of Law in Charlottesville. ?The legal argument is clear: If it comes to that kind of wrenching emergency where we have to press young people into service, there is no legal justification for saying that men alone need to shoulder that burden.?

The wars of the past decade in Iraq and Afghanistan have been fought by an all-volunteer force, since the US military discontinued the draft in 1973. Males between the ages of 18 and 25, however, are still required to register for the Selective Service.

Once the combat exclusion policy is lifted, ?My belief is that if we open up combat arms to women, even on a voluntary basis, if there is a draft, we should be able to force women into those positions,? says retired Col. Peter Mansoor, a professor of military history at the Ohio State University in Columbus and a former US Army brigade commander who served two tours in Iraq.?

?If women are acceptable to serve in combat, they are acceptable to serve whether they volunteer or not. You can?t have the frosting on the cake and not the cake underneath,? he says.

Legal precedent backs this up, adds Professor Coughlin, who has advised plaintiffs in lawsuits to overturn the Pentagon?s combat exclusion policy ? in particular a US Supreme Court case in 1981, Rostker v. Goldberg. In that suit, men argued that the draft is unconstitutional because only men are required by law to register. The Supreme Court rejected the premise of lawsuit.

?The court ruled that the Selective Service process is designed to assemble combat-ready people, and right now women are excluded from combat arms,? Coughlin says. ?Therefore they can?t participate in the very thing that the draft is for. Hence, it?s appropriate and constitutional to continue to exclude women from the draft.??

Yet in overturning combat exclusion for women, ?The male-only draft falls as well, no question about it,? she adds.

Critics of women in combat argue that culturally, the prospect of women being drafted might make the country reluctant to go to war.

To that, Professor Mansoor says, ?It should be: That?s exactly the debate the country needs to have.?

But while the notion of women being drafted ?may add some measure of hesitancy to the decision, I don?t see it as swinging the decision,? he says.

Even so, ?Congress and the president should agonize over going to war. Questions of war should be difficult,? Mansoor adds. ?They should not be as easy as they?ve been in the past 10 years.?

Linda Pugach, blinded in infamous NYC crime, dies

NEW YORK (AP) ? Linda Pugach, who was blinded in 1959 when her lover hired hit men to throw lye in her face ? and became a media sensation after later marrying him ? has died, her husband said Thursday. She was 75.

The infamous New York City crime was detailed in the 2007 documentary "Crazy Love."

Pugach, who hid behind dark glasses for the rest of her life, died Tuesday at the Long Island Jewish Hospital in Queens. The cause was heart failure, said her husband, Burton Pugach, who spent 14 years in prison for hiring the thugs to attack his then-girlfriend Linda Riss after she spurned him. He was married at the time, and the heinous attack became an instant tabloid sensation.

After his release, Pugach divorced his first wife and convinced Riss to marry him in 1974. He proposed to her on live television.

"This was a very fairy tale romance," a sobbing Pugach told The Associated Press on Thursday.

After the release of "Crazy Love," Pugach praised filmmaker Dan Klores for revealing a story that for the first time "has colors ? it was no longer black and white."

Two decades after his release from prison, Pugach was accused in another case with chilling similarities but acquitted of the charges in 1997. He had been accused of threatening and harassing another lover after she tried to end their five-year affair. That woman testified that he threatened to make it "1959 all over again."

He told the AP in an interview at the time: "Haven't you ever threatened to kill your husband? Did you mean it? Of course not. ... This has been blown out of proportion like I've never seen."

Linda Pugach testified at that trial, describing her husband as a good man. Under cross-examination by Pugach, a disbarred lawyer who defended himself, she said couldn't have sex with him after undergoing heart surgery in 1990.

"He was a naughty little boy and he was caught," she said as she left the courtroom on his arm. She said he was an adulterer, not a criminal.

Pugach said his wife went into the hospital on Dec. 26, 2012, two days before they had scheduled a trip to Florida to buy a property in Boca Raton.

"I don't know how I'm going to go on without her," he said.

On Thursday he again denied that he was ever involved in the attack.

"If I had told anyone to throw lye at her, would she have married me? A monster does that," he said.

Linda Pugach was being laid to rest in a crypt in Paramus, N.J. on Thursday.

"There's a place for me there. We'll be together," he said.

Set up great, meaningful SharePoint libraries ? Business ...

The beauty of SharePoint is how it can bend and flex to the individual end-user?s wants and needs. Here are a few options to consider when setting up your SharePoint libraries.

Shared documents or not shared documents

The best approach is to get rid of the Shared Documents library and challenge the team to specifically define what its document libraries should be. Otherwise, Shared Documents tend to be??come the ?junk drawer.? After a while, it?s worse than what you may have had on shared network drives. While you can have folders, many people just opt for dumping documents in the library, hoping search will find them later.

Ab Jackson, author of How to Organize Your Life & Get Rid of Clutter, says, ?Don?t ask where to put it. Ask, where am I going to find it?? Think about how you access your documents, and then build libraries around that.

How much control?

You?ll want to consider two types of control when creating a document library.

First, who should have access to the content? If the content itself is not secret or confidential, there is no reason why the entire organization can?t have read access to it.

Second, who should be allowed to add or change the content, and with what restrictions? For example, should an author be permitted to submit documents to a library pending approval? Should documents that have not yet been approved be visible to only a select few people? Permissions for the library in general can be set under Permissions and Management.

Other controls are set up in Versioning Settings, such as whether versioning should occur (minor and major versions), content approval for sub?mitted items and draft item visibility.

How should change occur?

You can make check in/check out mandatory in Versioning Settings to make sure that two people cannot make modifications at the same time.

There is a new way that controlled change can occur with SharePoint 2010 and Word 2010, co-authorship. If check in/check out isn?t required, two or more users can open the file for edit from SharePoint and may edit different paragraphs at the same time. Once a user starts typing in a paragraph, it becomes locked until that user refreshes it to SharePoint. This all happens with a simple click of the Save icon which, when documents are opened from SharePoint show a recycle arrow on top of the icon. The Navigation Pane in Word gives you an idea of what sections are being edited or which have already been changed since your last save.

So, be brave! Get rid of Shared Documents and start setting up your Team Site with meaningful, intentional libraries instead of creating one more catchall.
